The submission, lodged in The Hague by organisers of the Global Sumud Flotilla, includes survivor testimony, medical examinations and sworn legal affidavits gathered after Israeli authorities blocked flotilla missions attempting to deliver aid to Gaza during the spring of 2026, according to a statement issued by the group. Flotilla activists were abducted and jailed by Israeli authorities while in international waters. Some 430 activists, who were held after Israeli forces raided the Palestine-bound aid flotilla, were deported to Istanbul. Footage showed activists arriving at airports clad in grey prison tracksuits and keffiyehs with their fists raised, as families and supporters greeted them. Upon arrival, the activists reported being fired at with rubber bullets, beaten and subjected to sexual assault while in Israeli captivity. Organisers said the filing alleges war crimes, crimes against humanity, torture and other violations of international law linked to the interception and detention of participants. Flotilla participants said the evidence submitted to the ICC challenges Israeli officials' public account of the detentions. "The Israeli Ambassador looked Australian families in the eye and said our people were treated with great sensitivity," flotilla organiser Subhi Awad said in a statement. "Our people were beaten. Our people were tortured. Our people suffered sexual violence." Awad said Australians deserved answers regarding the treatment of participants held by Israeli authorities. Australian lawyer Bernadette Zaydan is among those involved in presenting evidence to the court, local media reported . The group also alleged that one Australian humanitarian worker was injected with an unidentified substance while in Israeli custody. "Neither the survivor nor the Australian public has been told what the substance was, why it was administered, or what the potential health consequences may be," Awad said. The submission comes as Israel has been added to the United Nations’ blacklist for sexual violence in conflict zones, following multiple reports by human rights organisations and media outlets - including Middle East Eye - documenting allegations of rape and other forms of sexual violence by Israeli forces against Palestinians since October 2023. According to the Jerusalem Post, which first reported the listing, the Israeli Prison Service (IPS) will be included in the 2026 blacklist, while other Israeli bodies remain under monitoring for possible future inclusion. Footage posted by Israel’s Interior Minister, Itamar Ben Gvir, taunting detained flotilla activists in a holding facility, drew condemnation from the UK, US, France, Italy and Canada. Images showed more than a hundred activists handcuffed and forced to crouch in an Israeli holding facility as guards manhandled some of the activists and waved Israeli flags in their faces. Australian participant Juliet Lamont criticised Prime Minister Anthony Albanese for declining requests to meet with activists upon their return to Australia. "Australian survivors have travelled halfway around the world seeking justice through international legal processes. Yet the prime minister will not even meet with them," Lamont said in a statement. "If Australian survivors can be heard in The Hague but not in Canberra, something has gone badly wrong," the statement added. The Australians involved in the mission include Neve O'Connor, Juliet Lamont, Zack Schofield, Surya McEwen, Sam Woripa Watson, Anny Mokotow, Bianca Pullman Webb, Ethan Floyd, Violet Coco, Gemma O'Toole and Helen O'Sullivan. Israel’s foreign ministry accused the flotilla of acting on behalf of Hamas and described the mission as a “provocation”, while maintaining that Gaza was “flooded with aid”.
